Draft for EU Data Protection Regulation again with Problems

Germany partly responsible

EU observer reports that Germany, as well as Sweden and Belgium are responsible for the delay.

The main topic is the so-called one-stop shop principle which is one of the basic principles of the reform and which some countries apparently don’t like. The one-stop shop means that only one data protection authority shall be competent for data processings which take place in different European member states. This authority should be the supervisory authority of the member state in which the controller or processor has its main establishment.

Overcomplicated law?

But why is Germany against the reform? According to the EU observer insiders believe that Germany does not want the EU regulation to be weaker than the German law.

Other member states may believe that the EU law is overcomplicated.

Reding not happy

Reding said that the idea of the one-stop shop principle is that one national data protection authority should be in charge for a company and for citizen’s complaints, not 28 countries. And this is what ministers agreed upon.

“Today, we have moved backwards,”

she said.
